These terms govern the use of the DishDuck apps and website, a service of D4U Software and Cloud Services LLC ("D4U", "we"), organized in New Mexico, United States. By using the service you accept them. If you don't agree, don't use it.
Who we are
DishDuck is made by D4U Software and Cloud Services LLC (“D4U”).

1. What DishDuck is
DishDuck lets restaurants publish their menu and their guests view it on their phone by scanning a QR code, and gives the restaurant's staff an app for each job. It has these apps:
- DishDuck Customers, for guests.
- Manager, for the person who manages the restaurant.
- Service, for the waiters who hand out the menu.
- Delivery, Register and Kitchen, for take-away and delivery orders, the register and the kitchen.
- Server, for the device that stays in the venue.
- Admin, the owner's read-only dashboard.
DishDuck doesn't charge guests for their meals: guests' payments go to the restaurant. We are not part of the relationship between the restaurant and its guests.
2. Who can use it
You must be at least [MINIMUM AGE] years old. To sign up for the service on behalf of a restaurant you must be of legal age and have the authority to bind it.
3. If you're a guest
- The app is free and doesn't require an account.
- Each menu opens for a limited time, set by DishDuck and not by the restaurant. To view it again you need to scan another QR code.
- The menu belongs to the restaurant. Prices, dishes, ingredients, allergens, images and availability are its responsibility. If you have allergies or dietary restrictions, always confirm with the staff.
- Images may be illustrative; the actual presentation may vary.
4. If you're a restaurant
- Account. You must give true information, keep your password safe and answer for what is done with your account and for the access you grant your staff.
- Your content. You keep ownership of your menu, text and images. You give us permission to host, process and display them in order to provide the service. You state that you have the right to use them and that the information is accurate, especially prices and allergens.
- Reporting content. Anyone can report a menu with photos that aren't the restaurant's, false information or offensive content by writing to reports@d4u.store. We review each report and may hide the content or suspend the account while we do.
- Payments for the service. The service is charged under the conditions shown when you sign up. Payments are processed by Stripe [to be confirmed]. [To be defined: renewal, top-ups, refunds, taxes and what happens to unused balance.]
- One QR per access. Each QR code gives a limited number of guests access to the menu for a limited time; DishDuck sets both limits. Getting around them is not allowed: for example, showing the menu to guests from a single phone or by other means to avoid generating codes, copying it or redistributing it outside the apps.
- Suspension. We may suspend an account for non-payment, abuse or breach of these terms, with notice where possible.
5. If you're on a restaurant's staff
Your access is authorized by the person who manages the restaurant and is personal: don't share it. The restaurant can remove it at any time.
6. Acceptable use
It is not allowed to:
- Use the service for illegal purposes or publish unlawful, misleading or offensive content.
- Try to access accounts, menus or systems without authorization, or get around the access limits.
- Copy, decompile or resell the service, except where the law allows it.
- Overload the service or extract its data by automated means.
7. Intellectual property
DishDuck, its name, logo, mascot and software belong to us or to those who license them to us. We give you a limited, personal and non-transferable license to use the apps under these terms. The apps include third-party components, acknowledged in the Credits section.
8. Availability
We work to keep the service available, but it may be interrupted for maintenance or for reasons beyond our control. Delivering the menu directly between phones depends on the hardware and the conditions of the venue. We may change or remove features.
9. Warranties and liability
The service is provided "as is". To the extent the law allows:
- We don't guarantee that it works without errors or interruptions.
- We are not responsible for the content of menus or for decisions you make based on them.
- Our total liability to a restaurant is limited to what it paid for the service in the [PERIOD] months before the event.
Nothing here limits the rights that the law of your country gives you as a consumer and that cannot be waived.
10. Termination
You can stop using the apps whenever you want. A restaurant can cancel its account from the web portal. We may end or suspend the access of anyone who breaches these terms.
11. Governing law
These terms are governed by the laws of New Mexico, United States, without prejudice to the mandatory consumer protection rules of your country. [To be defined with a lawyer: jurisdiction and dispute resolution.]
12. Changes
We may update these terms. We'll publish the new version here with its date and, if the change is significant, we'll announce it. Continuing to use the service after the change means you accept it.
